Doctrinal Elements of Treason

1. Allegiance

• Treason is breach of allegiance, owed permanently by citizens and temporarily by resident aliens (Carlisle v. United States, 83 U.S. (16 Wall.) 147 (1872)).

2. Levying War

• Requires an assembly of persons for a treasonable purpose; conspiracy alone is insufficient (Ex parte Bollman, 8 U.S. (4 Cranch) 75 (1807)).
• Armed resistance to enforcement of a federal law qualifies (United States v. Fries, 3 U.S. (3 Dall.) 515 (C.C. Pa. 1799)).
• Purely private disputes or minor local uprisings do not (United States v. Hoxie, 26 F. Cas. 397 (C.C. Vt. 1808)).

3. Adhering to Enemies / Aid and Comfort

• Defined as acts that strengthen the enemy or weaken the U.S. (Kawakita, 343 U.S. 717).
• Requires intent: disloyal thoughts alone are insufficient (Cramer v. United States, 325 U.S. 1 (1945)).
• Examples include:
  • Delivering prisoners (United States v. Hodges, 26 F. Cas. 332 (C.C. Md. 1815)).
  • Supplying hostile forces (Hanauer v. Doane, 79 U.S. (12 Wall.) 342 (1870)).
  • Propaganda broadcasts (Gillars, 182 F.2d 962; Chandler v. United States, 171 F.2d 921 (1st Cir. 1948)).

4. Procedural Safeguards

• Overt Act: Must show actual aid or comfort (Haupt v. United States, 330 U.S. 631 (1947)).
• Two-Witness Rule: Two witnesses must testify to the same overt act — a unique safeguard against political abuse.

President Donald Trump accused some media outlets of committing "virtual treason" on Tuesday with their coverage of the war in Iran.    

Trump's comments came in the form of a Truth Social post while he was traveling to Beijing on Tuesday afternoon for a bilateral summit with Chinese President Xi Jinping.

Just a reminder, I voted for Donald Trump in 2016 and again in 2024 because I actually believed him when he insisted that he would end the war in Ukraine fast. 

Ending the war in Ukraine has always been and still is a top priority!

However, I could never have imagined anything close to this from any president.

This wasn't the first time that Donald Trump committed treason by breaking with our own intelligence and cancelling the hard fought, very effective  JCPOA Obama Nuclear Deal that WAS WORKING, because Bibi Netanyahu told Donald Trump to do it in 2018!          

And replace it with.........NOTHING because with that nuclear peace deal in place,  Netanyahu was unable to use this false narrative, that's he's been using for 30 years to justify attacking Iran:

Preamble and General Provisions 
 
•    The full implementation of this JCPOA will ensure the exclusively peaceful nature of Iran’s nuclear program.
 
•    Iran reaffirms that under no circumstances will Iran ever seek, develop, or acquire any nuclear weapons.
 
•    This JCPOA will produce the comprehensive lifting of all UN Security Council sanctions as well as multilateral and national sanctions related to Iran’s nuclear program.
 
•    A Joint Commission consisting of the E3/EU+3 and Iran will be established to monitor the implementation of this JCPOA and will carry out the functions provided for in this JCPOA.  
 
•    The IAEA will be requested to monitor and verify the voluntary nuclear-related measures as detailed in this JCPOA. The IAEA will be requested to provide regular updates to the Board of Governors, and as provided for in this JCPOA, to the UN Security Council.  
 
•    The E3+3 will submit a draft resolution to the UN Security Council endorsing this JCPOA affirming that conclusion of this JCPOA marks a fundamental shift in its consideration of this issue and expressing its desire to build a new relationship with Iran.
 
Nuclear
 
Enrichment, Enrichment R&D, Stockpiles
 
•    Iran’s long term plan includes certain agreed limitations on all uranium enrichment and uranium enrichment-related activities including certain limitations on specific research and development (R&D) activities for the first 8 years, to be followed by gradual evolution, at a reasonable pace, to the next stage of its enrichment activities for exclusively peaceful purposes.  
 
•    Iran will begin phasing out its IR-1 centrifuges in 10 years. During this period, Iran will keep its enrichment capacity at Natanz at up to a total installed uranium enrichment capacity of 5060 IR-1 centrifuges. Excess centrifuges and enrichment-related infrastructure at Natanz will be stored under IAEA continuous monitoring.  
(Note: Iran currently has about 19,000 IR-1 and advanced IR-2M centrifuges installed)
 
-- Based on its long-term plan, for 15 years, Iran will keep its level of uranium enrichment at up to 3.67%.  

(Note: Prior to the Joint Plan of Action, Iran enriched uranium to near 20%)
 
-- Iran will refrain from any uranium enrichment and uranium enrichment R&D and from keeping any nuclear material at Fordow for 15 years.
(Note: Iran currently has about 2,700 IR-1 centrifuges installed at Fordow of which about 700 are enriching uranium)
 
•    Iran will convert the Fordow facility into a nuclear, physics and technology center.
 
•    1044 IR-I machines in six cascades will remain in one wing at Fordow. Two of those six cascades will spin without uranium and will be transitioned, including through appropriate infrastructure modification, for stable isotope production. The other four cascades with all associated infrastructure will remind idle.  
 
•    During the 15 year period, Iran will keep its uranium stockpile under 300 kg of up to
3.67% enriched UF6 or the equivalent in other chemical forms.  
(Note: Iran currently maintains a stockpile of about 10,000 kg of low-enriched UF6)
 
-- All other centrifuges and enrichment-related infrastructure will be removed and stored under IAEA continuous monitoring.

Summary
On May 8, 2018, President Donald Trump announced that his Administration would cease
implementing U.S. commitments under the 2015 multilateral Joint Comprehensive Plan of Action
(JCPOA) with Iran and reimpose all U.S. sanctions that were in place prior to the JCPOA. His
announcement made reference to his previous statements on the issue, including an October 13, 2017, announcement of U.S. strategy on Iran and a January 12, 2018, statement pledging to leave the agreement unless Congress and U.S. allies acted to address the full range of U.S. concerns on Iran. In his May 8 and earlier statements, President Trump asserted that the agreement does not address the full range of potential threats posed by Iran, or permanently ensure that Iran cannot develop a nuclear weapon. President Trump also again asserted that the JCPOA provided Iran with additional financial resources with which to pursue its ballistic missile program and support its regional “malign activities.” In his May 8 statement, President Trump indicated that reimposed U.S. sanctions would succeed in pressuring Iran to renegotiate the JCPOA to accommodate Administration demands.
President Trump’s May 8 statement also implied that, based on an early May presentation by Israeli Prime Minister Benjamin Netanyahu, Iran has not abandoned an intent to ultimately develop a nuclear weapon. (metmike: This was a previously proven lie).

International nuclear inspectors, as well as senior U.S. officials, have consistently indicated in their reports that Iran is complying with the provisions of the JCPOA.
The President foreshadowed his May 8 announcement with his October 2017 and January and April 2018 refusal to certify to Congress, under the Iran Nuclear Agreement Review Act
(INARA, P.L. 114-17), that continued U.S. sanctions relief to Iran under the JCPOA is
“appropriate and proportionate” to the measures taken by Iran to terminate its illicit nuclear
program. The withholding of that certification did not automatically reimpose any U.S. sanctions on Iran, but gave Congress the opportunity to use expedited procedures to do so. Congress did not act to reimpose the sanctions.
The other powers that negotiated the accord with Iran—Russia, China, France, Britain, and
Germany—have consistently asserted that the JCPOA is succeeding in its core objectives and that its implementation should not be jeopardized. Several European countries have sought to address President Trump’s demands in negotiations with U.S. officials. In late April 2018 visits to
Washington, DC, the President of France and the Chancellor of Germany told President Trump
they want to work with the United States to formulate joint action that would address his
concerns, but they urged that he keep the United States in the accord as a foundation on which to build additional restrictions on Iran. The leaders of Britain, France, and Germany, as well as the European Union, expressed “regret” about the U.S. decision and pledged to work with Iran to continue implementing the JCPOA. Iran’s President Hassan Rouhani immediately reacted to the May 8 U.S. decision by pledging to continue implementing the accord, provided Iran continues to receive the economic benefits of the agreement.
